Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://mtitelecoms.ca website (the “Service”) operated by MTI Telecoms Canada (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of MTI Telecoms Canada and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by MTI Telecoms Canada. MTI Telecoms Canada has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that MTI Telecoms Canada shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Privacy Policy

INTRODUCTION

At MTI Telecoms, we know your privacy is a serious matter. We strive to ensure that our use of your personal data is lawful and reasonable, with the ultimate goal of improving our services and your viewing experience.

This Privacy Policy describes how your personal data is processed at MTI Telecoms when you use our websites, applications, products, platforms and services to browse or to access content, including when you are not registered or signed into our service. Here we also provide some ways for you to exercise control over your personal data, and to contact us if you have questions. The personal data will be processed by MTI Telecoms in accordance with the Privacy Laws applicable in Canada.

We encourage you to read this policy completely so that you understand how we rely on personal data to create the best possible experience for you. We also use this policy to call your attention to the information about Cookies that help power our offerings from a technical perspective.

WHAT PERSONAL DATA DO WE COLLECT?

  • Viewing history and preferences: We collect information about the web content that you watch or interact with.
  • Support services information: We collect certain details of your interactions with the MTI Telecoms support centre (in case we can attribute the conversation to you), such as the date, time and reason for contacting MTI Telecoms, transcripts of chat, email or other conversations;
  • Cookies: We may also store certain information collected via the use of cookies, web beacons, advertising IDs and other technologies, including ad data. For more information on cookies please refer to the Cookies section of this Privacy Policy;
  • Information you share with us on social media: If you reach out to use via our social media profiles or you enter into a competition that we organize, we will process the information available in your social media profile, in particular, your name, surname and email address, and any other information that you voluntarily share with us.
  • Voluntary provision of data: The provision of your personal data is voluntary but necessary to use some of the services offered by MTI Telecoms. Refusal to provide some of your personal data will make it impossible to use the MTI Telecoms Service or some of their functionalities, for example its websites, applications, products, platforms and services to browse or to access content, and will prevent MTI Telecoms from offering and performing such services.

FOR WHAT PURPOSES DO WE PROCESS PERSONAL DATA?

  • To provide customer support services and to communicate with you, including through social media, and informing you about any changes to MTI Telecoms products and services; the processing of your personal data for this purpose is based on our legitimate interest;
  • processing for the purposes of establishment, exercise and defence of legal claims, enforcing or investigating potential violations of our terms of use or any other actual or alleged fraudulent activities (including copyright infringement), protecting rights, property or safety of MTI Telecoms, our customers, employees and other third parties; the processing of your personal data for this purpose is based on our legitimate interest; and
  • processing for the purposes of reorganization of the MTI Telecoms group, including changes in ownership or control of assets, shares or management of MTI Telecoms, or that of our affiliates; the processing of your personal data for this purpose is based on our legitimate interest.

WHO ARE THE RECIPIENTS OF PERSONAL DATA?

Your personal data may be disclosed to the following categories of recipients:

  • MTI Telecoms affiliates, which includes our holding companies, subsidiaries and entities that control or are under common control with MTI Telecoms, in particular when necessary for the ongoing maintenance and continued provision of the MTI Telecoms Service to you;
  • trusted service providers retained by us to enhance or provide the MTI Telecoms Service to you, acting at our instruction, including hosting services providers, platform provision, development and maintenance, support and security services providers, analytics tools providers, customer support services providers, payment and reconciliation services providers;
  • marketing services providers supporting us in promoting the MTI Telecoms Service, including marketing agencies, email distribution and other marketing tools providers, including targeted advertising, social media marketing services providers including Facebook and Google, as well as analytics services providers;
  • partners who may offer access to the MTI Telecoms Service on our behalf and/or partners with whom MTI Telecoms co-operates with respect to placing the MTI Telecoms App on their platforms;
  • third parties, including governmental bodies, courts or bodies of similar nature, when it is required in order to comply with applicable laws, to enforce or investigate potential violations of our terms of use or any other contract between you and us, to protect our rights, property or safety or that of our customers, employees, and other third parties; and/or
  •  third party in relation to reorganization of the MTI Telecoms group, in particular a third party that acquires (or proposes to acquire) ownership or control of our assets, shares or management, or that of our affiliates by any means, or a third party from whom we acquire, ownership or control of assets, shares or management.

In case of cross-border transfers of personal data, MTI Telecoms takes legally required steps consistent with applicable Privacy Laws to ensure that the personal data is adequately protected in each such jurisdiction in particular by basing agreements with the relevant data recipients on the highest standard of data protection.

WHAT ARE YOUR RIGHTS?

You have the following rights with respect to your personal data processed by MTI Telecoms:

  • Access: You have the right to access your personal data. To request access to your personal data, please email info@mtitelecoms.ca.
  • Rectification: You can ask us to have inaccurate personal data amended. For  rectification requests, please contact us via info@mtitelecoms.ca.
  • Erasure: You can ask us to erase personal data. To request erasure of your personal data, please email info@mtitelecoms.ca. Please note your request for erasure will result in the cancellation of any potential subscription which you will be notified of in advance. The scope within which we can comply with your request for erasure of personal data may be limited by our statutory obligations to store some personal data. We may also retain the personal data that is necessary for the establishment, exercise or defence of our legal claims.
  • Object to marketing: In the settings of your MTI Telecoms Account, we provide you with ability to express your preferences with respect to receiving marketing communication from MTI Telecoms. You can also opt out from receiving marketing communication using the means provided in each instance of communication (e.g., the unsubscribe link). Please note that it may take a few days for this request to be processed. You cannot unsubscribe from transaction or service administration related communication. In addition, you may opt out from receiving interest-based ads. You can also manage your preferences regarding the use of cookies and sharing of your data with our trusted partners for marketing and advertising purposes.
  • Object to other processing: You can object to processing of your personal data based on the legitimate interest of MTI Telecoms unless we have a valid ground to continue processing the data. In the settings of your MTI Telecoms Account, you may opt out from processing of analytics data and data from your account for the purpose of improving MTI Telecoms’s products and services. If you wish to object to any other processing based on our legitimate interest, please submit your request via info@mtitelecoms.ca.
  • Restriction: You may also request that we restrict the processing of your personal data, in particular if you believe that the processing is unlawful, or your data is inaccurate. To request restriction of processing, please contact as via info@mtitelecoms.ca.

Withdrawal of consent. In some situations, we may seek your consent for processing. In such case, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

We may ask for additional information from you to be able to identify you, including a proof of identity.

Complaints: You can raise a complaint about our processing with the data protection regulator in your jurisdiction. If you find it difficult to contact the data protection regulator, we will help you. Please contact us via info@mtitelecoms.ca for this purpose.

HOW LONG DO WE STORE DATA?

Data Retention Principles: We process your personal data during your subscription and following the end of your subscription to the extent that the data is necessary for the purposes with respect to which we are permitted and/or required to process data, including for the following purposes:

  • compliance with obligations resulting from applicable laws to which MTI Telecoms is subject;
  • establishment, exercise or defence of legal claims as well as for the purposes any other legal proceedings or compliance with any judgments and/or decisions issued by public authorities;
  • research and analytics; and
  • marketing of MTI Telecoms products and services.

Data Retention Principles with respect to consent: As outlined previously, we might be processing your data on the basis of consent. In such event we process data only as long as the consent is valid and to the extent that the data is necessary for the purposes with respect to which we are permitted and/or required to process data.

Where appropriate we will encrypt, pseudonymize, anonymize and/or segregate information so that we may make use of it in a manner that avoids unnecessary identification, in the interest of protecting your privacy and enhancing security practices.

SECURITY

Maintaining the security and integrity of your personal data is a high priority and we endeavour to maintain appropriate technical and organisational measures to secure the integrity of information, using accepted technological standards to prevent unauthorized access to or disclosure of your personal data and to protect them from misuse, loss, alteration or destruction.

COOKIES

In order to ensure that the MTI Telecoms Website, MTI Telecoms App and MTI Telecoms Service work properly, to provide you with a personalised experience, we and certain of our third-party service providers may set cookies or similar technologies such as in particular web beacons, SDKs, pixels and advertising identifiers (together hereinafter referred to as “cookies”) on your device, subject to your consent where relevant. A cookie is a small text file that a website saves on your computer or mobile device when you visit the website. It enables the website to remember your actions and preferences (such as session status, language, font size and other display preferences) over a period of time, so you don’t have to keep re-entering them whenever you come back to the site or browse from one page to another.

The MTI Telecoms Website uses two basic cookie types: session cookies and persistent cookies. Session cookies are temporary files stored on the user’s end device until the user logs out, leaves the website or closes the software (web browser). Persistent cookies are stored on the user’s end device for the time specified in the parameters of the cookies or until deleted by the user. All persistent cookies are deleted within 13 months from their placing on the device.

In many cases, the default settings of the web browsing software (web browser) enable cookie storage on the user’s end device. You can delete or block cookies from being set in your web browser settings or relevant software. Cookies set by MTI Telecoms will likely be labelled as first party cookies, and those set by our partners will be labelled third party cookies. Certain parts of the MTI Telecoms Website, the MTI Telecoms Service or the MTI Telecoms App may not work properly if first party cookies are blocked or deleted.

The types of cookies and the purposes for which they are used on the MTI Telecoms Website and the MTI Telecoms App include:

  • Strictly necessary cookies, which are required for the functionality of the MTI Telecoms Service, including security and fraud prevention, and to enable the purchasing process. Use of these cookies does not require your consent. If you set your browser to block these cookies, some parts of the MTI Telecoms Service may not function properly.
  •  Cookies for ensuring security, preventing fraud and debugging which help us monitor and prevent fraudulent activities and ensure that systems and processes work properly and securely. Use of these cookies does not require your consent.
  • Cookies for storing and/or accessing information on a device, which help us and our partners to store or access cookies, device identifiers or other information on your device. Use of these cookies is subject to your consent..
  • Cookies for personalised ads and content, measurement, audience insights and product development. Use of these cookies is subject to your consent. You can choose to consent to individual sub-categories of purposes, including (i) showing ads on third party websites based on the content you are viewing, the app you are using your approximate location, or your device type (basic ads), (ii) creating a profile about you and your interests for the purpose of suggesting relevant Content to you, (iii) suggesting Content based on a profile created about you, (iv) creating a profile about you and your interests for the purpose of showing relevant ads to you, (v) showing relevant ads based on a profile created about you (vi) measuring the performance and effectiveness of the Content you watch or interact with, (vii) measuring the effectiveness of ad performance, (viii) conducting market research (ix) developing and improving our products.

You will set your cookie preferences upon your first visit to the MTI Telecoms Website, the MTI Telecoms Service or the MTI Telecoms App. You can manage your cookie preferences and thereby withdraw your consent at any time by clicking on the link Cookie Preferences included in the appropriate footer of the MTI Telecoms Website or the settings of your MTI Telecoms Account.

CHANGES TO THIS POLICY AND FINAL PROVISIONS

  • We may change this Privacy Policy from time to time. If we do so, we will post the revised policy on MTI Telecoms and will inform subscribers of such amendments and of their effective date.
  • In case of discrepancy between this Privacy Policy and the Licence Agreement, the provisions of this Privacy Policy will prevail.
  • This Privacy Policy may be provided in several languages. In case of any discrepancy, the English version shall prevail.
